In complying with the requirement established in this Chapter, due account shall be taken of guidelines developed as referred to in Article 82b, the generally acknowledged state of the art, including as reflected in the relevant harmonised standards and common specifications as referred to in articles 40 and 41 or those already set out in Union harmonisation law;.
